1. Contingency Clause – Technical Failure & Recovery Plan
Although we take every precaution to protect your files, unforeseen technical issues—such as SD card corruption, data loss, or equipment malfunction—can occasionally occur. In the rare event that such an issue affects your session, Dayslens offers the following resolution options:
- If your photos and/or videos are unrecoverable or significantly compromised due to a technical failure, you will be offered one of two options:
- A full refund of any session fees paid.
- A complimentary reschedule of the session at no additional cost, to be booked within 30 days of the original shoot date (or at a mutually agreed-upon time).
Note: Once one of these options is selected, the alternative option is no longer available. This resolution closes the original session and no further services or compensation will be provided under that booking.
2. Revisions Policy
We understand that every client has unique preferences, and we offer a revisions process to help refine the final product. The number of revisions available depends on the package purchased:
- Each package includes a specific number of revisions, which will be clearly outlined at the time of booking.
- Revisions must be requested within 7 days of delivery of your final photos and/or video.
- Revisions may include minor adjustments such as lighting, color correction, cropping, or small video edits. Requests outside the scope of the included revisions may be subject to additional fees.
- Once the included revisions are used, any additional edits will be billed at a standard hourly or per-item rate (to be discussed and agreed upon in advance).
We aim to provide flexibility while maintaining a clear structure that supports both creativity and professional boundaries.
FEEs and fines
3. Late Arrival Policy
At Dayslens, punctuality is essential. Clients are granted a 15-minute grace period. After 15 minutes, a strict late fee of $25 will be added to your invoice. The session time will not be extended to make up for late arrivals. Repeat lateness may result in termination of service.
4. Travel Fees
Travel is automatically subject to a $10 fee regardless of location. If the location is more than 10 miles outside of our base zone, an $25 fee will be added. These fees are mandatory and non-negotiable. Travel distance is determined by GPS from the base address to the shoot location.
5. Overtime Fee
Clients who exceed the agreed-upon session time will be charged an overtime fee equal to the hourly session rate. For instance, if your session rate is $75/hour and your session exceeds the scheduled time by one hour, you will be billed an additional $75. This fee is strictly enforced.
6. Rushing Fee
Standard editing and delivery take 3–5 business days. If the client requires expedited delivery, the following Rush Fees apply:
24-hour turnaround: $50
48-hour turnaround: $25
Rush services must be requested and paid for at the time of booking. All rush requests are subject to availability and approval.
7. Client Responsibilities
Clients are responsible for arriving on time, dressed, and prepared for their session. Children must be supervised at all times. Cooperation and respect during the session are expected. Dayslens reserves the right to terminate the session without a refund for inappropriate or disrespectful behavior.
8. Liability
Dayslens is not liable for any injury, loss, or damage to persons or property during sessions. Clients assume full responsibility for themselves, their children, and guests. Dayslens is not responsible for missed moments due to lateness, lack of cooperation, or equipment failure beyond reasonable control.
9. Cancellations & Rescheduling
Cancellations must be made at least 24 hours in advance. A $25 cancellation fee will be applied to any cancellation. The original 50% non-refundable deposit will not be returned under any circumstances. Rescheduling is allowed one time without penalty, as long as it’s done 48 hours in advance.
10. Booking & Payment
To book a session with Dayslens, a 50% non-refundable deposit is required. This secures your session date and time. The remaining balance is due on the day of the session, before photography begins. Payments are accepted via cash, card, or approved digital payment methods.
11. Turnaround Time
Images will be delivered within 3–5 business days from the session date unless a rush fee has been applied. You will receive your images through a digital gallery link via email.
12. Weather Policy
Outdoor sessions are weather-dependent. If unsafe or unsuitable weather occurs, the photographer reserves the right to reschedule the session at no additional cost. Overcast, light rain, or wind does not automatically qualify for a reschedule unless it hinders equipment or safety.
13. Usage Rights
Dayslens retains full copyright and usage rights to all images taken. Images may be used for portfolio, website, marketing, or social media unless the client opts out in writing. Clients receive personal-use rights only. Commercial usage requires a separate agreement and licensing.
14. RAW Image Requests
Clients may request RAW, unedited photos. However, Dayslens does not guarantee the quality, color, or visual appeal of RAW files compared to professionally edited images. RAW files are delivered at the photographer's discretion, and no refunds or re-edits will be granted on RAW files.
